WHT Claims

 

Claim Format

The Tribunal is primarily an investigative and evidence based adjudicative body administered by the Ministry of Justice.

The application for adjudication must include:

  1. Completed Tribunal claim form
  2. The claim statement - need not be formatted in a formal Statement of Claim, however this has proven useful in the past.
  3. Copy of the eligiblity notification
  4. If the claim is for $20,000 or less - a copy of the Department's lower-value claim dispute resolution certificate
  5. Names and current addresses (if possible) for the respondents
  6. List of relevant documents - to support the claim
  7. Expert or technical evidence of the claim - this may include experts' reports, witness statements, tribunal assessors report. Such reports must meet details set out in s 42 of the Weathertight Homes Resolution Services Act 2006. This includes:
    • The cause
    • The extent of damage
    • The work needed to
    • The estimated or actual cost of the remedial work

Application fee is currently $400

 

Claim Process Timelines

The claim is registered with the Tribunal and assigned to a Tribunal Member and a case manager. The procedure timelines are tight and under statutorily imposed time restrictions. The average time over 338 claims was 19.8 weeks with “approximately 85% claims being settled either at mediation or by direct negotiation between the parties prior to a formal adjudication”.
